The UK's Court of Appeal has ruled that photographs of out-of-copyright work cannot themselves be copyrighted.

It's specifically reproduction of existing 2d works, right?
By default photographs are copyrighted; if you take a picture of a painting in its frame, hanging on a wall, that photograph is copyrighted. It's not just reproducing the painting, but part of a specific composition.
